UGC Music for Brand Use: Confirm the Actual Licence

A creator’s permission to use their video does not settle every sound in it. Review the music against the brand’s intended destination before treating a finished UGC file as ready to publish.

Separate the recording from the audio permission

List the sound sources in the delivered asset. Music added during editing, a song playing in the room and audio embedded in supplied footage can all need attention. A creator may control their performance while having no authority to grant the brand every proposed use of a third-party recording.

The creator usage-rights schedule should describe the video and intended uses. Keep a separate record of the music evidence instead of assuming the creator’s signature settles material supplied by someone else.

Start this check while planning the shoot. If a scene depends on a recognizable song or a product display captures background audio, resolve the production choice before paying to create a version that may need rebuilding.

Write the destination before selecting the track

Specify who will publish, on which platform, in which territory, for how long and with what form of commercial use. Brand organic posting, creator posting and client-run advertising should not be silently treated as the same permission.

TikTok’s Commercial Music Library guidance tells businesses to select the campaign region and available placements. That is a concrete reason to review the actual selection and use, rather than rely on the fact that a creator found a sound inside an app.

Do not extend that guidance into a claim that the same export is cleared for every other platform. Ask the party responsible for rights to confirm the proposed off-platform use from the actual terms or arrange a suitable alternative. 3betmedia’s production scope does not replace that decision.

Build an audio register the next editor can use

Attach the audio record to the exact asset version. A filename such as “final licensed music” tells the next team little if the underlying source, permitted use or required credit is missing.

Check attribution and permission as separate questions

YouTube distinguishes Audio Library tracks that require Creative Commons attribution from tracks under its standard library licence that do not require attribution. Review the selected track’s actual entry and keep any required wording with the publishing instructions.

Crediting a musician does not itself answer every permission question. Nor does the absence of a required credit establish an unlimited commercial licence. Keep the intended use and the relevant terms together.

If someone supplies only “royalty-free” as the evidence, ask for the actual source and terms. Do not publish a universal interpretation of that phrase, promise that a claim can never happen or infer that a subscription held by one editor covers every client destination.

Request useful production alternatives

Where the accepted scope permits, request a clean dialogue version and separate audio elements alongside the final mix. This can make a later destination-specific edit possible without asking the creator to repeat the whole performance.

Those files still need clear labels and permission. A silent master does not solve third-party material visible in the footage, and removing a music layer does not prove that all background audio disappeared. Listen to the complete exported version.

Add the agreed alternatives to the creator production brief. Do not assume that raw files, separate stems or unlimited future remixes are included in a quote that names only one finished video.

A fictional handoff finds a destination gap

A creator delivers a product demonstration intended for one named platform. Another team later asks to use the file on its website and in an advertising account. The supplied audio record does not establish those additional uses.

The team holds that version while the responsible owner checks the terms. It can ask for a separately reviewed audio alternative if the production agreement supports one. It does not declare the original music unlawful or assume that changing the soundtrack resolves every rights issue.

This is an invented handoff example, not a client dispute. Bring the intended destinations, existing files and permission records to a UGC creator management call so the next order includes the versions the brand actually needs.

Frequently asked questions

Does paying a UGC creator give the brand every music right?

Do not assume that. Confirm the third-party audio source, actual permission and intended use separately from the creator’s recording agreement.

Does a credit line replace permission to use a song?

No. A required credit is one condition to check. It does not by itself establish that the proposed commercial use is permitted.

Should a brand request a version without added music?

It can be useful when included in the accepted production scope. Label and review that export separately, including any background audio that remains.
