NFT Creator Campaigns: Product, Access and IP Rights

An NFT campaign should explain a real collection, feature or access task. Commissioning hype about a future floor price does not give the audience useful product evidence.

Choose a supported audience task

Decide whether the creator explains collection access, demonstrates an available feature or discusses the artwork with appropriate permission. State what exists today and what is only proposed. Do not present a roadmap benefit as a current entitlement.

Keep investment outcomes out of an unsupported brief. A creator cannot establish future demand, resale value or liquidity through enthusiasm. If the product requires financial-promotion review, resolve that before production rather than treating a collectible label as an exemption.

Check the artwork licence

Holding an NFT does not automatically grant every commercial right in the underlying image. OpenSea’s own marketing-feature guidance explicitly distinguishes token holdings from the rights required to license artwork. Review the actual collection and permitted use.

The Copyright Office is a primary reference for the separate rights question. Ask who may display, crop, animate or sublicense the material for the intended content. A screenshot supplied by the buyer does not prove that all downstream advertising uses are cleared.

Make the paid relationship and experience accurate

The FTC’s guidance concerns truthful endorsements and material connections where applicable. Disclose the commercial arrangement appropriately, including material benefits relevant to the representation. Do not script an independent collector opinion for a paid performer with no such experience.

If a creator owns an item, that fact does not make every statement about the product supported. Separate their genuine experience from issuer claims about utility or future availability. Review the complete edit for implied profit promises.

Use a hypothetical rights conflict

A fictional collection allows personal display but has not granted the commercial sublicensing needed for a brand advertisement. The production team holds the planned artwork-led ad and asks the rights owner for a decision. It does not interpret wallet possession as permission.

The alternative may be a differently scoped explanation using cleared materials, if the reviewer approves it. The creator should not recreate the protected artwork or remove identifying detail simply to work around the unresolved licence.

Define delivery beyond the launch date

Record the approved artwork, product facts, posting window, retained content and correction process. A feature or access condition can change after recording, so give the team a route to address outdated material. Keep the content licence and expiry with the final files.

3betmedia can discuss creator selection, briefing and production. It does not guarantee mint demand, floor-price growth or secondary-market sales. Bring the actual audience task and rights evidence, not a request to manufacture scarcity or independent enthusiasm.

For tokenised off-chain assets, use an RWA-specific evidence packet rather than treating the artwork licence as proof of asset rights.

Frequently asked questions

Does NFT ownership include commercial artwork rights?

Not necessarily. Review the collection licence and the intended use; do not infer a broad marketing licence from token possession.

Should a creator campaign promise floor-price growth?

No unsupported financial outcome should be promised. Commission a truthful product or access explanation instead.
