Prediction Market Advertising Rules: Who Allows Ads in October 2026

Prediction market advertising rules, checked 23 October 2026: Google allows ads only from CFTC-regulated exchanges and NFA brokers in the US outside five states, TikTok approves them case by case in 17 markets, X bars paid gambling affiliates, and the NFL bans them outright. States keep pushing back, and both Kalshi and Polymarket have had creator programmes go wrong. Here is who allows what, with a source for every line.

So can prediction markets advertise? It depends on the channel, the location, and whether the brand is a regulated exchange, a broker or an affiliate.

Google prediction market ads: CFTC-regulated only, five states out

Google announced its prediction markets ad policy on 5 January 2026, and it took effect on 21 January 2026 (PPC Land, 6 June 2026). Only two kinds of US advertiser qualify: a designated contract market authorised by the CFTC whose main business is listing exchange-listed event contracts, or a brokerage authorised by the NFA to give access to a qualifying exchange's contracts (Google Ads Help). Offshore platforms are out (Covers, 7 January 2026).

Certification is per location, and the approved list keeps shrinking. Nevada was excluded from the start. Ohio followed on 2 June 2026, Michigan and New York on 13 July 2026, and Connecticut on 7 October 2026 with no transition period (PPC Land, 11 October 2026).

Two more lines matter for anyone working with creators. Google disapproves informational sites, blogs and affiliate pages that offer trading tips, signals or broker reviews, wherever they target. Markets on games of chance count as gambling, not as prediction markets. So Google prediction market ads means the exchange's own ads, not an affiliate's review site.

Social platforms: Meta, X and TikTok

Meta. We could not find a Meta ad standard that names prediction markets as of 23 October 2026. Meta's advertising policies allow ads that promote online gambling and gaming only with its prior written permission (ConductAtlas record of Meta's policy, captured July 2026). Until Meta says otherwise in writing, plan as if a prediction market ad needs the same permission.

X. In February 2026 X changed its paid partnerships policy to bar paid affiliate accounts from promoting gambling products, sports betting included. Its head of product posted that the change meant a world "without prediction market spam on X". Kalshi removed all its affiliate badges on X on 23 February 2026 (Front Office Sports, 23 February 2026).

TikTok. In July 2026 TikTok began allowing prediction market ads in 17 markets, including the US, Canada and the UK. Approval is not automatic: the advertiser works with a TikTok sales representative. TikTok looks at whether the product describes users as trading or betting, and ads that use betting or gambling terms are not eligible (Gambling Insider, 21 September 2026).

Video and live platforms: YouTube, Twitch and Kick

YouTube. Since 19 March 2025 YouTube has barred creators from directing viewers to gambling sites Google has not approved, through links, logos or verbal mentions, and it age-restricts online casino promotion (CNN via ABC11, 5 March 2025). That rule does not name prediction markets, and sponsorships kept growing. Tubefilter counted at least 101 Polymarket and 140 Kalshi sponsored YouTube videos in the 90 days before February 2026, citing Gospel Stats (Tubefilter, 3 February 2026). ThoughtLeaders counted 127 Polymarket-sponsored long-form videos in September 2026 (ThoughtLeaders, 15 October 2026).

Paid YouTube ads run under the Google Ads policy above. YouTube's homepage Masthead opened to certified gambling advertisers on 21 October 2026; that notice does not cover prediction markets.

Twitch. Twitch's gambling guidance does not mention prediction markets. Sports betting, fantasy sports and poker may be streamed with the Gambling label, while links and referral codes for slots, roulette and dice sites are banned (Twitch). Treat a sports contracts stream like a sports betting stream and label it.

Kick. From February 2025 Kick allows gambling streams only from sites that verify users with ID (SBC News, 3 December 2024). We found no Kick rule naming prediction markets, so treat these streams as gambling content.

NFL prediction market ads, the Super Bowl and other leagues

Prediction markets are on the NFL's list of prohibited ad categories. A source told Front Office Sports the category was added before the 2025 season, that no prediction market commercials ran on NFL broadcasts all season, and that the ban covered Super Bowl LX on 8 February 2026. (Front Office Sports, 29 January 2026).

So prediction market Super Bowl ads did not air in 2026.

The league then tightened the rule. DraftKings, FanDuel and Fanatics, its sportsbook partners for 2026, cannot use league ties to advertise their prediction markets, and NFL chief revenue officer Renie Anderson said: "They cannot do anything with prediction markets." On 3 September 2026 the league's chief compliance officer wrote to exchanges asking them to stop listing contracts on player injuries, officiating calls and player conduct (Gambling.com, citing Sports Business Journal, 18 September 2026).

The NHL went the other way. In October 2025 it signed multi-year deals naming Kalshi and Polymarket official prediction market partners, with use of league marks and virtual ads during broadcasts (Crowdfund Insider, 22 October 2025). As of January 2026 the NFL, MLB and NBA had not embraced prediction markets (Front Office Sports, 8 January 2026).

States and the CFTC

The CFTC backs the exchanges. On 17 February 2026 chair Mike Selig said the agency would file friend-of-the-court briefs to defend its "exclusive jurisdiction" over these markets, and warned states: "we will see you in court" (Axios, 17 February 2026). In March 2026 he said the CFTC would issue guidance and an advance notice of proposed rulemaking on what exchanges can self-certify (The Block, 3 March 2026). None of the CFTC statements we reviewed sets advertising rules for event contracts.

Many state gaming regulators treat sports event contracts as sports betting. Tennessee's Sports Wagering Council sent cease-and-desist letters to Kalshi, Polymarket and Crypto.com on 9 January 2026, telling them to stop offering sports contracts, void positions and refund customers by 31 January (CasinoBeats, 12 January 2026). By February 2026 Nevada, Massachusetts, Maryland, Arizona, Michigan, New York and Illinois had taken legal action against prediction markets (Axios).

Courts are split. The Third Circuit upheld Kalshi's New Jersey injunction on 7 April 2026, while Massachusetts won an injunction in January 2026, Ohio's Casino Control Commission fined Kalshi $5 million, and New York sued on 31 July 2026 (Lines.com state tracker, updated September 2026). Ohio regulators treat sports event contracts as unlicensed gambling, which is the background to Google's Ohio exclusion (PPC Land).

A creator post that is lawful in one state may look like an ad for unlicensed betting to the regulator in the next. This page is not legal advice.

Polymarket and Kalshi influencer marketing, and what went wrong

Both exchanges built large creator programmes fast. In October 2025 Protos described both paying crypto creators undisclosed sums to carry affiliate badges on X, with creators switching sides within weeks (Protos, 7 October 2025). By early 2026 Tubefilter reported sponsorship deals with hundreds of creators, with YouTube as the main channel.

Then came the problems:

  • Income framing. Media Matters documented Kalshi TikTok ads with young creators calling it a "money hack" and a "side hustle", one claiming $761.07 overnight. Kalshi said it no longer works with those creators (Media Matters, 30 March 2026).
  • Disclosure. BBB National Programs' National Advertising Division said on 8 June 2026 it would refer Kalshi to state attorneys general and the platforms involved after Kalshi declined to take part in its review of influencer disclosures (BBB National Programs).
  • Election claims. After the June 2026 Los Angeles primary, paid creators on both platforms used shifting odds to suggest fraud. The posts carried a tiny paid partnership tag, and creators were reportedly offered up to $500 a post. Kalshi now bars affiliates from questioning election integrity, and Polymarket pulled back some sponsorships (NPR, June 2026).
  • Fake wins. The Wall Street Journal found Polymarket paid at least ten influencers about $2,000 to $3,000 a month for videos of winning bets that were never placed. Of 1,105 videos reviewed, about 70% showed a bet and none were real, and creators were told not to disclose (TechSpot, reporting the WSJ, 22 June 2026).

The cheap part of these programmes was the post. The expensive part was the headline. Our guide to prediction market KOLs who actually trade covers how to screen for creators whose positions are real.

What a prediction market brand can do with creators safely

Creator campaigns still work when the brief closes these gaps. We write these rules into every brief and contract:

  • Eligible geos only. List the states and countries where the product is legal for each audience, exclude contested states for sports contracts, and ask creators for their audience location split.
  • Disclosure in the post. The FTC wants the paid relationship stated in plain words where people will see it, and repeated during live streams (FTC). A tag in small type is not enough.
  • No "free money" framing. No income claims, no "side hustle", no "money hack", no win-only edits. Losses are shown alongside wins.
  • Adults only. Creators 18+, and 21+ where the market or the brand's own terms require it. Skip channels with a large under-18 or under-21 audience.
  • Real positions. Every trade on screen is a real position on the creator's own account, with a link to prove it.
  • No election or integrity claims. No posts that question results, and no promotion of injury, officiating or conduct markets the leagues object to. No NFL marks.
  • Platform terms first. Use the trading language TikTok requires, the Gambling label on Twitch, and no affiliate badges on X.

Our creator ad disclosure examples show wording and placement by platform, and the gambling influencer marketing compliance guide covers age and market gating. To budget a compliant test, read the prediction market influencer cost guide first.

How to use this tracker

Treat every row as dated: Google changed its state list three times between June and October 2026. Before a campaign, confirm in writing that the channel accepts the product in the target geo, the exchange or broker is registered for that audience, and the creator's audience sits in eligible locations. If you want us to run that check, the prediction market influencer marketing page explains how we scope it.

Methodology

We checked every source on 23 October 2026 and kept only what the source states. Where a platform publishes no rule naming prediction markets, we say so.

Frequently asked questions

Can prediction markets advertise?

Yes, but only on some channels and in some places. As of 23 October 2026, Google allows ads from CFTC-designated exchanges and NFA-registered brokers in the US outside five excluded states, TikTok approves them case by case in 17 markets, and Meta requires prior written permission for gambling-type ads. X bars paid affiliates from promoting gambling, and the NFL does not accept prediction market ads at all.

Does Google allow prediction market ads?

Yes, since 21 January 2026, in the United States only. The advertiser must be a CFTC-designated contract market or an NFA-registered broker and hold Google certification for each location. Connecticut, Michigan, Nevada, New York and Ohio are excluded, and affiliate review sites and tip sites cannot advertise under the policy.

Can prediction markets run NFL or Super Bowl ads?

No. Prediction markets have been on the NFL's prohibited ad list since before the 2025 season, and none ran during Super Bowl LX in February 2026. In September 2026 the league also said its sportsbook partners cannot use league ties to advertise their prediction market products. The NHL, by contrast, has Kalshi and Polymarket as official partners.

How do Polymarket and Kalshi use influencer marketing?

Both have paid hundreds of creators on YouTube, X and TikTok, with reported fees of up to $500 a post and, in Polymarket's case, monthly retainers of about $2,000 to $3,000. In 2026 the programmes drew criticism over weak disclosure, income claims, election fraud posts and fake winning bets, and Kalshi dropped its X affiliate badges and now bars affiliates from questioning election results.

How can a prediction market brand use creators safely?

Book creators only in states and countries where the product is legal for that audience, disclose the paid relationship in plain words in every post and during live streams, and ban income claims and win-only edits. Work with adult creators and audiences, 21+ where required, show only real positions, and follow each platform's own rules on wording and labels.
