Separate the production fee and the licence
The creator’s time to plan and film is one purchase. Permission to use the resulting work is another commercial component, even when a supplier bundles both. Ask for the scope rather than demanding that every quote display a particular pricing structure.
The Copyright Office’s guidance establishes that copyright carries distinct rights and can be licensed or transferred. The actual agreement and jurisdiction control. This article offers a comparison method, not legal advice or a universal market rate.
Create a scope line for each asset
Record the approved file, channels, brand accounts, territory and term. State whether use is organic, paid or both. Add permitted edits and whether the creator’s name, voice or likeness can appear outside the original asset.
Do not treat a worldwide perpetual buyout as comparable with a short licence for one account. A broad rights request can restrict future creator opportunities and may include uses the buyer never needs. Ask for the scope required by the actual campaign.
Price extension options before the deadline
Agree how a renewal is requested, what material must be reviewed and when continued use must stop if no extension is accepted. A licence expiry should be in the asset register, not only in an old email attachment.
For a hypothetical app campaign, the buyer needs three months of specified paid use and may request another three months later. Compare a defined extension option with the cost and flexibility of the initial term. Do not present either quote as an industry benchmark.

Check the rights the creator cannot supply
Music, other people, stock assets and product material can carry separate restrictions. A creator’s broad licence does not establish permission from every third party. Ask which elements need replacement or additional clearance for the planned use.
Keep digital replicas, synthetic voice and model-training use out of an ordinary assumption about editing. If those uses are proposed, they require an explicit and appropriately reviewed decision, not a hidden interpretation of “all media”.
| Scope axis | Quote A | Quote B |
|---|---|---|
| Approved assets | List the exact files | List the same or different files |
| Media and accounts | Record actual intended uses | Explain any broader permission |
| Term and territory | State requested boundary | Normalise to that boundary |
| Edits and derivatives | List necessary changes | Identify exclusions and extra clearance |
| Extension | Written option or later negotiation | Comparable renewal terms or unresolved |
Compare the usable package
Place production, licence, optional extension, source files and changed-scope costs in one worksheet. Mark unavailable terms as unresolved. Do not fill the gap with a made-up percentage of the talent fee.
Choose the quote that delivers the needed permission and work under understandable terms. A cheaper file that cannot be used on the intended surface is not cheaper usable content. Bring the actual distribution plan to the creator-planning conversation so the licence request remains proportionate.
Put the agreed licence into the UGC contract schedule before commissioning the shoot.
Frequently asked questions
Is there a standard UGC usage-rights percentage?
There is no single defensible rate for every creator, asset and use. Compare current quotes against an identical licence scope.
Do paid rights include creator-account permission?
Not automatically. Legal usage rights and platform account or post permissions are separate requirements.
