Separate volunteered content from a commission
A customer’s unsolicited product photo and a paid creator’s briefed video have different origins. Both may use an informal style, but the paid asset is commissioned marketing. Calling it UGC does not make it independent customer opinion.
Write the origin and intended use in the brief. If you want existing customer material, establish permission and truthful context. If you want a commissioned demonstration, hire the production skill and define the deliverable. Do not invent a customer history to make the asset sound more authentic.
Distinguish the footage from distribution
A creator can make a video for the brand without posting it to their own audience. An influencer deal can separately purchase a post or live appearance. Following size may matter for distribution, but it is not the primary proof that someone can film a clear product demonstration.
Ask whether the price includes production only, a creator-channel placement or both. Keep editing, source footage and downstream usage explicit. A file delivered to your inbox does not automatically include every right your media plan needs.
Choose the kind of evidence the message needs
A demonstration can show a supported product action. A testimonial represents the speaker’s genuine experience and needs the appropriate factual basis. An actor reading a script cannot truthfully claim a personal result they never experienced.
The FTC’s endorsement guidance addresses material connections and truthful representations where it applies. Paid content also needs the relevant platform and jurisdiction review. An informal phone-camera look does not exempt an advertisement from those requirements.

Describe one useful commission
Consider a hypothetical wallet team commissioning a short navigation explanation. The creator records the approved test environment, identifies the feature and supplies clean footage for a defined edit. They do not claim investment gains, personal long-term use or product security they cannot establish.
The buyer receives an observable production deliverable. Any creator posting, paid amplification or additional language version is scoped separately. This makes acceptance practical and avoids a generic demand for “authentic content” that nobody can verify.
| Content origin | Purchased work | Separate decision |
|---|---|---|
| Volunteered customer material | Permission for an existing contribution | Truthful context and actual reuse rights |
| Commissioned demonstration | Defined product footage and performance | Brand distribution and licence |
| Genuine testimonial | Supported account of real experience | Disclosure and claim review |
| Influencer placement | Content plus an agreed audience surface | Posting, retention and reporting terms |
Give the buyer a clean next step
Prepare the product facts, audience task, planned surfaces and rights term. Decide whether a customer contribution, commissioned footage or influencer distribution answers the need. The Copyright Office’s guidance is a reminder to resolve rights rather than assuming that possession of a copy settles ownership or reuse.
3betmedia can discuss creator selection, briefing and content production for the actual service scope. This is a guide for brand buyers, not an application for creator jobs or a promise of guaranteed ad results. Bring one specific content task to the planning call.
Compare a UGC marketplace with an agency after deciding whether you need access to creators or managed production.
Frequently asked questions
Do UGC creators have to post on their own account?
Only when the agreement includes that distribution. Production for brand use and access to a creator’s audience are separate purchases.
Can paid UGC look like a customer review?
It must not fabricate independent opinion or personal experience. Use truthful demonstrations and the applicable commercial disclosure.
